Terms & Conditions

These Terms & Conditions govern reservations and participation in activities offered by Island Water Sports LLC (“Island Water Sports,” “we,” “us,” or “our”), located at 9701 3rd Avenue, Stone Harbor, NJ 08247. By booking a reservation with us, you agree to these terms.
Bookings & Reservations
When you book, a $3 reservation fee is charged to your card to confirm your spot. The remaining balance for your trip is paid in cash at the dock on the day of your reservation. Your full trip total is due in cash before departure.
Please arrive at least 15 minutes before your scheduled trip time at 9701 3rd Avenue, Stone Harbor, NJ. Trips depart on schedule, and late arrivals may shorten your time on the water or be treated as a no-show.
Payment
The $3 reservation fee is processed securely through Square. We never see or store your full card details. The balance of your trip is payable in cash only at the dock. We do not accept card, check, or other forms of payment for the trip balance.
Cancellations
You may cancel free of charge up to 24 hours before your trip. We send confirmation reminders before your trip and encourage you to cancel as early as possible if your plans change — a cancellation always helps us offer your spot to someone else.
Cancellations made close to your trip time, or failure to show up for your reservation, may result in a charge for the full trip amount. The $3 reservation fee is refundable when you cancel within our cancellation policy, or if we cancel your trip for any reason.
Weather & Operator Cancellations
Your safety comes first. If conditions are unsafe, we may cancel or reschedule your trip at our discretion. If we cancel your trip for weather or any other reason on our end, your $3 reservation fee is refunded in full and you are under no further obligation. We do not issue forced credits — whether you rebook is entirely up to you.
Waivers, Age & Safety
All participants (or a parent or legal guardian, for minors) must sign a liability waiver in person at our dock before participating. By booking, you agree that you and everyone in your party will complete this waiver on arrival.
Aqua Park participants must be at least 6 years old. All participants must be able to follow our captains’ and staff’s safety instructions. We reserve the right to refuse participation to anyone we determine, in our sole judgment, cannot safely take part.
Assumption of Risk & Liability
Water sports and marine recreation activities carry inherent risks, including but not limited to the risk of injury, drowning, collision, equipment failure, and the dangers of open water and changing weather. By booking and participating, you acknowledge and voluntarily accept these risks on behalf of yourself and all members of your party.
To the fullest extent permitted by law, Island Water Sports, its owners, employees, captains, and agents are not liable for any injury, loss, or damage to persons or property arising from participation in our activities, except where caused by our gross negligence or willful misconduct. The terms of the waiver you sign at the dock apply in full to your participation.
Text Messages (SMS)
By booking a reservation — including by phone, where our staff will ask for your consent — you agree to receive transactional text messages about your reservation, including booking confirmations, a link to complete your reservation, trip reminders, and cancellation or schedule notices. Message frequency varies based on your reservation activity. Standard message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. No mobile information or SMS opt-in consent will be shared with or sold to third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for full details.
Photos & Video
We operate in public spaces — our dock, our boats, and our aqua park. During normal operations, we and our staff may take photographs or video that include guests, and we may use these images in our marketing materials, including our website and social media. If you prefer not to appear in marketing photos or video, let our staff know at check-in and we will accommodate your request.
Changes to These Terms
We may update these Terms & Conditions from time to time. When we do, we will revise the effective date above. Your continued use of our services after changes are posted constitutes acceptance of the updated terms.
Governing Law
These Terms & Conditions are governed by the laws of the State of New Jersey, without regard to its conflict-of-law provisions.
